DMCA Policy for Nhl Trade Deadline Rfa
Nhl Trade Deadline Rfa respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Nhl Trade Deadline Rfa will respond expeditiously to claims of copyright infringement committed using the Nhl Trade Deadline Rfa service and/or website (the "Site") if such claims are reported to Nhl Trade Deadline Rfa's Designated Copyright Agent identified below.
Filing a DMCA Infringement Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Nhl Trade Deadline Rfa's Designated Copyright Agent.
Upon receipt of the Notice as described below, Nhl Trade Deadline Rfa will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.
DMCA Notice of Alleged Infringement ("Notice") must substantially include the following:
- Identify the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by this Notice, a representative list of such works.
- Identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Nhl Trade Deadline Rfa to locate the material (e.g., URL of the page where the material is located).
- Provide your contact information, including your name, address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Filing a DMCA Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to Nhl Trade Deadline Rfa's Designated Copyright Agent:
- Identify the specific URLs or other unique identifying information of material that Nhl Trade Deadline Rfa has removed or to which Nhl Trade Deadline Rfa has disabled access.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Nhl Trade Deadline Rfa may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
Please note that Nhl Trade Deadline Rfa may send a copy of your counter-notification to the original complaining party. The complaining party will then have 10 business days to inform Nhl Trade Deadline Rfa that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on the Site. If Nhl Trade Deadline Rfa does not receive such notification within 10 business days, we may reinstate the removed material.
